HOA just banned Airbnbs... what can I do?

Hey guys, I just found out that my HOA has made a new rule saying I can’t list my house on Airbnb. I was thinking about putting it on Airbnb later this year, so this is a bit of a bummer. Is there anything I can do to get the HOA to remove this rule? Any tips or strategies would be super helpful!

You could try participating in HOA meetings and see if others are willing to change the rule. Maybe get on the board and bring it up for another vote. But honestly, it sounds like they might just want to avoid that kind of use.

If you can gather like-minded folks, you might be able to get elected to the board and work on removing the rule. It’s a long shot, but it’s worth a try.

Not if it’s in the CC&Rs. Changing those usually needs a 2/3 majority and any non-vote is counted as a no. That’s what makes it tough. If you’re on the board, you have to enforce the CC&Rs.

You might have to contact the HOA and review the documents. Getting other homeowners on your side, proposing the change, and having community meetings will be needed too.

Becoming a board member could help. If you can campaign to allow Airbnb, that might change things. But it feels like a bit of a losing battle. This rule might actually be good for your community.

You should consult a real estate lawyer familiar with your area. Some places have limits on what HOAs can regulate. Otherwise, if your property wasn’t a short-term rental before this rule, there might not be much you can do.

Was the rule put in place before or after you bought the property? I’ve heard that only rules in effect when you purchase can be enforced.

I worked for a leasing company and the only way to get around HOA rules is to do short-term rentals for 30 days or more. My HOA doesn’t allow any rentals at all.

I wonder how other owners feel about renting their place out to Airbnbs. It must be a weird situation having temporary neighbors at your home.
