We’re located in NC and are in a tough spot with our seller’s agent. They’ve been doing more harm than good and won’t let us out of the contract until the end of this month. Our house has been on the market for 50 days without any open houses or price reductions. Communication has been poor, and they haven’t marketed the property as promised.
Now, they want to rent the house to some people they know to “help us” catch up on our missed mortgage payments because we’re facing foreclosure. They don’t want to attempt to sell our house until next spring, and if we agree to rent the house, we also have to sign a new agreement allowing them to sell the house in the spring.
They recently called my husband and gaslit him the entire time. It’s an ongoing issue, and we just want to get out of the contract.
Has anyone dealt with something similar? Any advice on how to break the contract would be greatly appreciated. Thanks
I have experienced a similar situation before. If your seller’s agent is not meeting their obligations and communication is lacking, you may have grounds to terminate the contract. Consulting with a real estate lawyer can provide valuable insight into potential legal options. They can help you identify any contract clauses that might allow you to exit the agreement earlier.
Your seller’s agent is clearly not acting in your best interest. Document everything. Keep copies of all communication, including emails, texts, and voicemails.
You may Consider these options:
Talk to the agent’s broker: Explain the situation and request a new agent or termination of the contract.
Consult a real estate attorney: They can review your contract and advise on your options, including potential breaches of contract by the agent.
Explore termination clauses: Check your contract for any conditions that allow early termination.
Be prepared to negotiate: If you can’t break the contract, be firm in your refusal to rent the house or sign a new agreement.
