Need help with house title issues after my wife's passing

I’m in a tough spot after my wife passed away from cancer early this year. We bought our house together in 2011, but even though I was on the loan, I’m not on the warranty deed. My wife refinanced in 2017 and didn’t add me to the deed. Now, with financial difficulties piling up after her passing, I need advice on how to obtain a clear title and get my grandma (who was a co-signer) to sign off. I want to make sure my 10-year-old daughter feels secure during this time. Any help or guidance would be greatly appreciated!

I’m so sorry for your loss. It sounds like a really challenging situation. You might want to consult a real estate attorney who can help you navigate the title issues.

Yes, definitely get legal advice! They can help you understand your rights and what steps to take.

Since you’re in Michigan, you may be able to file a petition with the court to establish your rights to the property as the surviving spouse.

That sounds like a good option. Have you looked into what paperwork you’d need for that?

@Indra
You’ll likely need your marriage certificate and your wife’s death certificate, among other things.

I’d recommend talking to your grandma about the situation. If she’s willing to help, it might make the process smoother.

I plan to! I just want to approach it the right way.

Look into a quitclaim deed. If your grandma agrees, she can sign it over to you, which could simplify things.

Good idea! Just make sure you understand the implications before proceeding.

I’m really sorry you’re going through this. It’s important to take care of your mental health too. Make sure you’re looking after yourself and your daughter.

Thank you! I appreciate the support. It’s been tough, but I’m doing my best for her.
